These terms govern your use of experienx.com. They are short on purpose, and none of them change what we agree with a client in an engagement letter.

Accepting these terms
By using this website you accept these terms. If you do not, please do not use the site. We may update them; the date above shows the current revision, and using the site after a change means you accept the revised version.
This site is not advice
Everything here is general information about what Experienx Technology Corporation does. It is not technical, financial, legal or professional advice, and it is not an offer to provide services on any particular terms. Nothing on this site creates a client relationship, and you should not act on it without advice that accounts for your own circumstances.
If we work together, a signed engagement letter or master services agreement governs that work. Where anything on this site conflicts with that agreement, the agreement wins.
Our content
The text, design, graphics, logos and code on this site belong to Experienx Technology Corporation or its licensors and are protected by copyright and trademark law. You may read, print and share pages for your own reference and to evaluate working with us. You may not republish, sell or systematically copy the content, use our name or marks to suggest an endorsement we have not given, or scrape the site.
Using the site
Please do not attempt to interfere with the site or its security, access anything you are not authorised to, submit anything unlawful or misleading through the contact form, or use the form to send unsolicited marketing.
Anything you send us through the contact form is handled as described in ourprivacy policy. Do not send confidential or sensitive information through it — email is not a secure channel, and until we have an agreement in place no duty of confidentiality applies to what you send.
Links to other sites
Where we link to a third party, we do so for convenience. We do not control those sites and are not responsible for their content, their security or their privacy practices.
No warranties
The site is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that its content is complete or current.
Limitation of liability
To the fullest extent the law allows, Experienx Technology Corporation and its personnel will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of this site — whether the claim is in contract, tort or otherwise, and even if we were told such damages were possible.
Our total liability arising out of or relating to this site will not exceed one hundred US dollars (US$100). Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Where we operate
We are based in Houston, Texas, and our services are offered to businesses in the United States. This site is not directed at individuals in the European Economic Area or the United Kingdom, and we do not monitor behaviour there. If you use the site from outside the United States, you do so on your own initiative and are responsible for compliance with your local law.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of them or out of your use of this site will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.
If any part of these terms is held unenforceable, the rest stays in force. Our not enforcing a term on one occasion does not waive it.
